The service we provide

DataCaffe Technologies Pvt. Ltd. ("we", "us", "DataCaffe") provides Lumara, a SaaS product for window-coverings businesses, accessible via web browser and mobile PWA, as described on how-it-works and lifecycle.

By signing up for Lumara, you (the "tenant" — the business entity using Lumara) agree to these terms. If you are signing up on behalf of a company, you confirm you have the authority to bind that company.

Your account and use

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account or any user you invite into your tenant.
  • Ensuring users you invite are bound by their own acceptable-use obligations.
  • Promptly notifying us of any unauthorised access at security@datacaffe.in.

Subscription, billing, taxes

Pricing is published on /pricing and billed in advance — monthly or annually depending on the plan you select. All amounts are in Indian Rupees and inclusive of GST as applicable (CGST + SGST inside Maharashtra, IGST inter-state).

We accept payment via UPI, bank transfer (NEFT/RTGS), credit/debit card (via Razorpay), and corporate purchase orders for annual contracts. A proper GST tax invoice is issued every billing cycle, addressed to your tenant's GSTIN.

Setup fees are charged once at the start of a subscription unless waived (e.g., annual plans). Add-ons and overages (WhatsApp messages above plan limit, additional storage) are billed monthly in arrears.

Cancellation, refunds, data export

You can cancel any month after the first by emailing billing@datacaffe.in with 30 days' notice. Annual contracts run for 12 months; cancellation within that period does not trigger a refund of the unused months unless we materially breach this agreement.

On cancellation, you have 90 days of read-only access to your tenant to export data (PDF/CSV bundles, full SQL dump available on request). After 90 days, your data is deleted from primary systems within 30 days and from backups within 90 days, subject to legal retention requirements (e.g., financial records under the Income Tax Act).

Acceptable use

You agree not to use Lumara to:

  • Violate any law (Indian or international applicable to your operations).
  • Send unsolicited bulk communications (spam) to your customers via our WhatsApp/SMS integration.
  • Attempt to reverse-engineer, decompile, or extract source code of Lumara.
  • Resell, sub-license, or white-label Lumara without a separate written agreement.
  • Overload, attack, or interfere with the service for any tenant including your own.

Violation of acceptable use may result in account suspension after one warning, or immediate suspension in cases of active abuse.

Intellectual property

The Lumara software, brand, logo, content, design system, and all underlying code are the intellectual property of DataCaffe Technologies Pvt. Ltd. You receive a non-exclusive, non-transferable, revocable licence to use the service for your business operations during your subscription.

Your data remains yours. The operational data you enter into Lumara — customer records, quotes, invoices, photos, signatures — is your property. We hold it on your behalf under the Privacy Policy.

Uptime and service levels

Our uptime targets, measured monthly:

  • Starter: 99.0% (≈ 7.3 hours downtime / month tolerated)
  • Atelier: 99.5% (≈ 3.6 hours / month tolerated)
  • Maison: 99.9% (≈ 43 minutes / month tolerated)

If we miss the SLA in any month, we credit your next invoice 10% (Starter), 20% (Atelier), or 50% (Maison) of the monthly fee. Scheduled maintenance (announced 48 hours in advance, capped at 4 hours / month) and force-majeure events do not count toward downtime.

Disclaimers and limitation of liability

Lumara is provided "as is". We make no warranty that the service will be uninterrupted, error-free, or fit for any particular purpose beyond what is explicitly described in our documentation.

To the maximum extent permitted by law, DataCaffe's total liability under this agreement, in any 12-month period, is capped at the fees you paid us in that period. We are not liable for indirect, consequential, or punitive damages, or for loss of profit, revenue, or business opportunity.

Nothing in this agreement limits liability for gross negligence, fraud, or breach of statutory obligations that cannot be excluded by law.

Termination by us

We may suspend or terminate your account if:

  • You materially breach these terms and fail to cure within 14 days of written notice.
  • You fail to pay an invoice within 30 days of the due date and after one follow-up reminder.
  • You engage in active abuse of the service that endangers other tenants or our infrastructure.
  • A regulatory authority directs us to do so under applicable law.

On termination by us, you retain the same 90-day read-only data-export window unless the termination is for clear illegal activity.

Governing law and disputes

This agreement is governed by the laws of India. Any dispute will be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, seated in India, conducted in English, by a single arbitrator agreed by both parties (or appointed by the competent High Court if no agreement is reached within 30 days).

Changes to these terms

We may update these terms when we add new features, change pricing structures, or are required to by law. Material changes are emailed to the tenant admin at least 30 days in advance. If you disagree with a material change, you can cancel without paying for the affected period.
